Terms of Service

The following conditions (hereinafter the “Terms of Service) are applicable for the software solutions on this site, developed by BOJA Technology AB previously named BOJA Consulting AB (hereinafter "Company"), and provided as a Software-as-a-Service over the Internet.

Grant of License

The Licensor grants to Licensee a Licensee a limited, non-transferable, royalty-free license to use the Software in accordance with the terms of this agreement.

System Availability

The solutions are running on infrastructure from Google Firebase (OKR by BOJA, Risk Register, Agile Project, Issues on Timeline and Org Chart) and Amazon AWS (Easy Exporter). The Company will provide solution availability offered by those services.

Termination

Both parties can terminate the contract. The Company holds the right to partly or fully terminate the contract without prior notice. Upon termination by the user the solution fee payed will not be reimbursed.

Data

You grant the Company permission to store and process the data needed to operate and improve the solution.

Warranties and Disclaimers

THE INFORMATION, SOFTWARE, SOLUTIONS, PRODUCTS AND SERVICES OFFERED BY THE COMPANY BE OUT OF DATE OR INCLUDE OMMISSIONS, INACCURACIES OR OTHER ERRORS. EXCEPT WHERE EXPRESSLY PROVIDED OTHERWISE IN AN AGREEMENT BETWEEN YOU AND THE COMPANY, ALL INFORMATION, SOFTWARE, PRODUCTS AND SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. THE COMPANY HEREBY DISCLAIMS ALL WARRANTIES WITH RESPECT TO THIS INFORMATION, SOFTWARE, PRODUCTS AND SERVICES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, OR DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA OR USE, INCURRED BY YOU OR ANY THIRD PARTY, WHETHER IN AN ACTION IN CONTRACT OR TORT, ARISING FROM YOUR ACCESS TO, OR USE OF, THE SOLUTION. THE COMPANY RESERVES THE RIGHT TO MAKE CHANGES OR UPDATES TO THE SOLUTION AT ANY TIME WITHOUT NOTICE.

Limitations of Liability

Under no circumstances shall the Company be liable for any direct, indirect, incidental, special or consequential damages, resulting from: (a) the use or the inability to use the solution; (b) any other matter related to the solution, even if the Company has been advised of the possibility of such damages.

Indemnification

You agree to indemnify and hold each of the Company, their subsidiaries, affiliates, officers and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the site in violation of these Terms of Use by you, or the infringement by you of any intellectual property or other right of any person or entity.

Publicity

You are permitted to state publicly that you are a user of the solution. You agree that the Company may include your name and trademarks in a list of the Companys Customers, online or in promotional materials. You also agree that the Company may verbally reference you as a customer of the Service. You can withdraw your permission as outlined in this section by e-mailing a request to the Company.

Governing Law and Jurisdiction

The Company is located in Sweden and any legal issues shall be governed by Swedish law.

Changes to the Terms of Service

The Company reserves the right, at our sole discretion, to modify or replace these Terms of Service by posting the updated terms on the Site. Your continued use of the solution after any such changes constitutes your acceptance of the new Terms of Service. (latest update 2023-09-01)
